How we work

How We Handle EB-5 Matters

  1. Consultation and Strategy

Tell us about your capital, your timeline, and your goals. We will tell you honestly whether the EB-5 fits and what it will take.

  2. Evidence and Petition Assembly

Direct investment or a regional center project, and the source-of-funds documentation behind the capital.

  3. Drafting, Review and Filing

We draft the petition, review it with you before anything is submitted, and file it.

  4. Decision and Next Steps

The sequence continues through conditional residence and removal of conditions. We update your estimate as the matter progresses.

Questions

Frequently Asked Questions

Which visa is right for my situation?

It depends on whether your strongest asset is capital, a record of achievement, or an existing company. The E-2 turns on investment and treaty nationality. The O-1 turns on documented recognition. The EB-5 turns on a larger capital commitment and job creation, and it leads to permanent residence rather than temporary status. A consultation is the fastest way to narrow it down.

Can citizens of any country apply for the EB-5?

Yes. Unlike the E-2, the EB-5 is open to any nationality, which is why investors from non-treaty countries like India and China often choose it.

Can I switch from an E-2 to an EB-5 later?

Yes. Many investors start on an E-2 to get to the U.S. quickly and build their business, then pursue an EB-5 or another green card path later. They are not mutually exclusive.

How long does the process take?

Timelines vary by visa, by filing office, by consulate, and by country of origin, and they change. We give you a current estimate at the consultation and update it as your matter progresses. We will not quote you a timeline we cannot stand behind.
