EB-2 NIW Attorney (2026): Requirements, Cost, Timeline and Who Qualifies

By Talia Harari, Attorney at Law. Updated September 2026.

The EB-2 NIW (National Interest Waiver) is a green card you petition for yourself when your work benefits the United States. It suits researchers, engineers, founders, physicians, and many kinds of specialists. There is no employer, no job offer, no labor certification, and no lottery.

Key Takeaways

  • The NIW is a green card you file for yourself: the job offer and labor certification a normal EB-2 case needs are waived.
  • You must first fit EB-2: an advanced degree (or a bachelor’s plus 5 years of progressive experience) or exceptional ability.
  • The case turns on three prongs: the merit and national importance of your work, your record of being well positioned to advance it, and the benefit of waiving the job offer.
  • Premium processing is available, for a petition decision in 45 business days.
  • Your spouse and children under 21 receive green cards with you.

How We Handle EB-2 NIW Cases

We prepare NIW petitions in four steps, and we tell you plainly at step one whether the case is there.

  1. Consultation and strategy. We test your background against the EB-2 base and the three prongs, define the endeavor, and decide whether the NIW, the EB-1A, both, or an O-1 first fits your goals.
  2. Evidence and petition assembly. We build the endeavor statement, line up four to seven recommendation letters with weight on independent experts, and gather proof that you deliver. Timing here depends on how quickly letters and records come together.
  3. Drafting, review and filing. We draft the petition letter prong by prong, you review it with us, and we file the I-140 with premium processing if you choose it.
  4. Decision and next steps. The I-140 decision commonly takes around a year on the regular track, or 45 business days with premium processing. After approval you wait for a current priority date, then the green card step commonly runs 6 to 14 months inside the U.S.

Who the NIW Fits, and Who It Does Not

The stereotype is a researcher with publications, and researchers do well. But the category is much wider, and what unites strong cases is a clearly framed endeavor plus evidence of delivery.

Who This Visa Fits

  • You hold an advanced degree, a bachelor’s plus five years of progressive experience, or exceptional ability.
  • Your work touches health, security, energy, technology, or the economy: founders creating jobs, engineers in critical technologies, physicians in shortage areas, researchers.
  • You want a green card without depending on an employer.
  • Your spouse and children under 21 are part of the plan.

Who It Does Not Fit

  • You need to be working in the U.S. within months: a pending I-140 gives no status by itself.
  • You have neither an advanced degree nor exceptional ability; the O-1 requires neither.
  • Your endeavor matters only to one company or town, not beyond.
  • Your record is top of field and you were born in India, where the faster EB-1A queue, or filing both, may serve you better.

What Is the National Interest Waiver?

The NIW removes the employer from an EB-2 green card case. A normal EB-2 needs an employer, a permanent job offer, and a labor certification proving no qualified U.S. worker wants the job. The NIW waives all three when your work is important enough to the country.

That one waiver changes the whole case. Instead of proving a labor-market fact, you prove that your endeavor matters to the United States and that you are someone who delivers on it.

Who Qualifies: The Two Layers

Qualifying takes two layers. Layer one is the EB-2 base: an advanced degree (a master’s or higher, or a bachelor’s plus five years of progressive experience in your specialty), or exceptional ability shown through at least three of six regulatory criteria. Layer two is the waiver itself, decided on the three-prong Dhanasar test.

  • Prong 1: substantial merit and national importance. Your proposed endeavor, the work you will pursue in the U.S., matters beyond one company or town.
  • Prong 2: well positioned to advance it. Your education, track record, funding, and plan show you can actually deliver.
  • Prong 3: on balance, waiving helps the U.S. Given prongs one and two, requiring a job offer and labor certification would not serve the national interest.

How Much Does the EB-2 NIW Cost?

Government fees for the petition run about $1,000 in total, and premium processing adds $2,805 if you want speed. The later green card step has its own fees. Our legal fee is flat and quoted in full before we begin.

How Long Does the EB-2 NIW Take?

Two clocks run in sequence. The I-140 petition takes several months on the regular track, or 45 business days with premium processing.

Then comes the visa bulletin clock. EB-2 numbers are limited per year and per country, so after approval you wait for your priority date before filing the final step. Most nationalities currently measure that wait in months to a couple of years; applicants born in India or China wait substantially longer.

NIW vs EB-1A, O-1, and PERM

Each alternative trades something different against the NIW. Here is how the three closest routes compare.

NIW vs EB-1A

Also a self-petitioned green card, with a higher bar: the top of your field, with sustained acclaim. The EB-1 queue moves faster for nearly every country, dramatically for India, and many strong candidates file both.

NIW vs O-1

The O-1 is a temporary work visa filed by an employer or agent, needing 3 of 8 extraordinary ability criteria and no degree. It can have you working in weeks to months and pairs naturally with a pending NIW: status now, green card in parallel.

Compare O-1 and NIW

NIW vs PERM

A standard employer PERM case needs a job offer and a labor certification. The NIW trades that employer dependence and labor-market test for the burden of proving national importance yourself.

Can Your Family Come With You?

Yes. The NIW is a green card case, so your spouse and unmarried children under 21 are included as derivatives. While your adjustment of status is pending inside the U.S., your spouse can apply for a work permit. Once green cards arrive, everyone works and studies freely.

Frequently Asked Questions

What is the EB-2 NIW in plain terms?

It is a green card category for professionals whose work matters to the United States. The National Interest Waiver removes the usual job offer and labor certification requirements, so you file for yourself, with no employer.

Do I need an employer or a job offer?

No. Removing the job offer requirement is the whole point of the waiver. You self-petition, and once you immigrate you can work for anyone, or for yourself.

Do I need a PhD or publications?

No. You need an advanced degree (or a bachelor’s plus five years of progressive experience) or exceptional ability, plus a persuasive case on the three prongs. Entrepreneurs and industry professionals qualify without academic records.

How long does the whole process take?

The I-140 petition takes months, or 45 business days with premium processing. You then wait for your priority date before filing the final green card step. Most countries currently wait months to a couple of years; India and China wait substantially longer.

Can my family immigrate with me?

Yes. Your spouse and unmarried children under 21 receive green cards as derivatives of your case. Your spouse can work once their adjustment-of-status work permit or green card arrives.
